What Is the Kratom Consumer Protection Act?
The Kratom Consumer Protection Act (KCPA) applies to states where kratom is legal. This legislation states that while consumers have legal access to buy and consume kratom, kratom products should be regulated on the market. This means kratom vendors need to be approved and sell safe kratom products that meet the parameters set by the Food and Drug Administration (FDA).
For kratom sellers, this means that the products they sell must be safe and unadulterated. They have the responsibility to ensure their products meet the FDA’s standards, sell properly labeled products, and are duly registered.
For consumers, this means that they have access to quality kratom that is safe. When they deal with registered kratom sellers, they can be confident that their kratom products meet the required standards that make it safe to use.
Which States Practice The Kratom Consumer Protection Act?
While the KCPA was initiated by the federal government, the federal government has delegated the matter of kratom regulation to individual state governments. This means that each state has their own KCPA that regulates kratom sales and consumption.
Some states have relatively lenient laws on kratom, while other states have passed their own version of the KCPA. Although there are some slight differences, most of these acts are derived from the original federal act, so there are many similarities between states. As of writing, the states that have their own version of the kratom consumer act include:
- Utah – the first state to pass their own KCPA on March 2019
- Georgia – passed kratom legislature on April 2019
- Arizona – passed their version of the kratom act on May 2019
- Nevada – Nevada KCPA signed on June 2019
- Oregon – passed their own KCPA on June 2021
As of writing, kratom is illegal in six states: Alabama, Arkansas, Indiana, Rhode Island, Vermont, and Wisconsin. For the rest of the states in the US, Kratom is either legal or legal with regulations and restrictions (i.e. age restrictions for users, or while it is legal in some states but banned in certain cities within the state).

The team at Dakind Botanicals believes that adults in the United States should have the choice to use kratom for its many benefits. However, it’s not enough to simply put kratom products in the market. Without KCPAs to protect the quality of kratom that goes in the market, sub-standard kratom products could be sold and give users a terrible kratom experience.
Like pharmaceutical medicines and other food and beverages, kratom products need to meet certain standards for consumers’ safety. When made ethically, distributed, sold, and consumed correctly and responsibly, kratom can be used safely.
If we sold kratom products that went below the FDA standards and our even higher product standards, the results for our customers would be awful. Not only would they get a poor kratom experience that may not give them all the benefits kratom is known for, but adulterants in the products could make it unsafe. This would give kratom an unfair bad reputation – all because it was sold improperly.
